A record of a sordid, 19th-century, San Francisco scandal, the publication presented the memorable argument of prominent attorney and President of the San Francisco & Oakland Railroad Alfred Andrew Cohen (1829 - 1887), in defence of his client George W. Tyler. Tyler, another attorney, had represented Annie A. Pratt during her divorce from Orville C. Pratt, a well-known judge, for the latter had been caught gallivanting with another woman. Annie had been awarded over $700,000 of hush money, but had ultimately refused to pay Tyler his fees, for which, consequently, he was suing her. Laid in at the end is a one page Memorandum of the Court on Motion for Injunction, by Judge Dwinelle. Cohen was a leader of California's early Jewish community, a prominent attorney, and a railroad promoter. Here he takes on the Town of Alameda and its trustees, who seek to open a road along his land and charge him and abutting landowners with the costs. Cohen claims that Robinson, a trustee, would derive substantial financial benefit from the road. His lobbying and subsequent participation in the trustees' decision is a disqualifying conflict of interest. Cohen's passionate argument carried the day: the Court held that Robinson's actions flagrantly breached his duty, and granted the injunction. FIRST EDITION. Rocq 317.
