Baton Rouge, Louisiana: Printed At the Gazette and Comet Book and Job Office, 1864. Wraps. Very good condition. A Southern imprint recording the Civil War service of a New York volunteer regiment from Dutchess and Columbia counties, which was mustered for 3 years service in September of 1862, departing the Hudson River town of Hudson NY on the steamer 'Oregon'. Company H consisted of men from Fishkill, Poughkeepsie, Hyde Park and Beekman. The 128th New York Volunteer Infantry Regiment, nicknamed Old Steady, was first attached to the defenses of Washington DC; then moved to New Orleans, taking part in the siege of Port Hudson, and then proceeded to Baton Rouge. They fought at Monett's Ferry, Winchester, Fisher's Hill, and Cedar Creek. They mustered out in July of 1865 at Savannah. 8vo, 15pp. Printed pink paper wrappers, with the seal of the 128th at the front wrapper. Tide mark in upper right corner, wrappers somewhat dusty. Congress passed an amendment to the Enrollment Act on March 3, 1865; this is sometimes referred to itself as the Enrollment Act of 1865. Section 21 of the Act (13 Stat. 490) imposed denationalization (loss of citizenship) as a penalty for draft evasion or desertion. Justice John Marshall Harlan II's dissent in Afroyim v. Rusk mentioned the Enrollment Act of 1865 as an example of a law in which citizenship could be revoked without a person's consent and that the Congress then regarded it as constitutional.
